Although this was not the amount the bank was asking for, they continued to accept the payments monthly, whilst continually threatening court action etc. Nothing would ever come of this as they were accepting payment and so cannot take action against him for non-payment.
My question is, would we still be able to make a claim for bank charges like many others are doing, or have we broken a contract by not making the payments the bank were asking for? If we have broken some kind of agreement, would this mean we don’t have a leg to stand on when it comes to claiming for our money back on the unfair charges?

I must add that the ‘debt management’ company we are using is not paid by us, they make their money from the bank rather than by demanding a payment from us. Not that this is relevent to my question.
